Two bail petitions are being heard together and disposed off by common order as two cases arise in connection with Kusheshwar Asthan P.S. Case No. 118 of 1999 registered under Sections 143, 341, 342, 447, 323, 307, 379, 427, 504 of the Indian Penal Code and Section 27 of the Arms Act.
There is allegation that petitioners along with other coaccused persons abused the informant and damaged the tiles of the
Patna High Court Cr.Misc. No.36613 of 2014 (2) dt.11-02-2015 house of Nandi Paswan, cousin brother of the informant. Learned counsel for the petitioners submits that, though, there is allegation of firing but no one has injured. It is further submitted that petitioner, Narayan Singh is not sent up for trial and allegation against petitioner, Chandra Mani Singh, is not verified, though, charge sheet has been submitted against other co-accused persons.
Having regard to the facts and circumstances of the case, the above named petitioners in the event of their arrest/surrender within a period of four weeks from the date of receipt of copy of order in the court below shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate/Sub-Divisional Judicial Magistrate, Benipur, DistrictDarbhanga, in connection with Kusheshwar Asthan P.S. Case No.118 of 1999, subject to condition as laid down under Section 438(2) of Cr.P.C. Further condition that petitioner will appear on each and every date fixed in this case.
