JUSTICE ARUN KUMAR ORAL ORDER 16-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Begusarai Rail P.S.Case No. 09 of 2017 registered under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substance Act.
Allegation in brief is that altogether 24 Kg 150g Ganja was recovered from the possession of the petitioner being carried in two bags.
Submission is that there is no independent witness and recovery is only 14Kg 350g and another bag was not of the petitioner.
Having considered the aforesaid facts and circumstances and the recovery of commercial quantity from the possession of the petitioner, his prayer for bail is refused at present.
Patna High Court Cr.Misc. No.1915 of 2018 (3) dt.16-02-2018 2/2 Trial court is directed to expedite trial and conclude the same preferably within a year. If trial is not concluded within stipulated period, petitioner may renew his prayer for bail. (Arun Kumar, J) Sujit/- U T
