JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Mufassil P.S. case no. 52 of 2018 for the offence under Section 392 of the Indian Penal Code.
The case was registered against four unknown persons. The name of the petitioner has been transpired in the instant case on the basis of confessional statement of co-accused. Learned counsel for the petitioner submits that the petitioner is in custody since 04.05.2018, but he was not put on Test Identification Parade. He further submits that nothing was recovered from the possession of the petitioner or from his house. Considering the fact that the case was registered against unknown and nothing was recovered from the possession of the petitioner or from his house and also the fact that the

No.54752 of 2018 (2) dt.28-09-2018 2/2 petitioner is in custody since 04.05.2018, but he was not put on T.I.P., the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each after 21.10.2018 to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Mufassil P.S. case no. 52 of 2018.
