JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 17-05-2016 Heard Mr. Sunil Kumar for the petitioner as well Mr. Dhananjay Kumar for the respondent Nagar Parishad, Bettiah, West Champaran. The petitioner retired as Sweeper from the service of the Nagar Parishad, Bettiha on 30.05.2011. It is stated that she is entitled to payment of the post retrial dues under the heads GPF, gratuity and unutilized leave encashment but those dues have not been paid. The respondents did not even pay heed to her representation and hence the writ application. The counsel for the Nagar Parishad states that if a fresh representation is filed detailing the claims, the same shall be examined and admissible dues shall be authorized to her.

Mr. Sunil Kumar, the counsel for the petitioner, considering the said

Patna High Court CWJC No.11128 of 2015 dt.17-05-2016 2/2 submission of the respondent, agreed for disposal of the application at this stage. Let the petitioner file a fresh representation raising a grievance with respect to non-payment of the post retrial dues payable to her upon superannuation before the Executive Officer, Nagar Parishad, West Champaran, Bettiah (respondent no.6). If any such application is filed within 04 weeks, the said respondent will not only consider and examine the same but also authorize the admissible legal dues of the petitioner within a maximum period of 08 weeks from the date of filing of the representation. The application stands disposed of.
