20-11-2017 Heard Sri Ramesh Kumar, learned counsel assisted by Sri Sanjay Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor.
Two petitioners, who are in custody since 03-08-2017 in Murliganj P.S. Case No. 244 of 2017 registered for offence under Sections 25(1-b)A/26/35 of Arms Act, 1959, have prayed for grant of bail.
By way of referring to statement made in paragraph - 3 of the petition, learned counsel for the petitioner that petitioners are having clean antecedent and on false accusation, they were arrested, as if, petitioner no. 1 was carrying one loaded pistol and petitioner no. 2 was carrying one live cartridge. He submits
Patna High Court Cr.Misc. No.55442 of 2017(2) dt.20-11-2017 2/2 that save and except the present case, petitioners were not made accused in any other case.
Considering the nature of accusation, period of custody and clean antecedent, let both petitioners namely Dhirendra Yadav @ Dhirendra Kumar and Ghanshyam Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 244 of 2017.
