JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-08-2023 The present writ petition has been filed seeking the following relief:- "1(A). To call for and quash the order by which the brother of the petitioner Bachhu Paswan has been appointed on compassionate grounds in place of his deceased father Hari Paswan, who died in harness on 17.4.2013 as Chowkidar in Circle 2/5 Thana No. 631."

At the outset, the learned counsel for the RespondentState submits that the petitioner has the remedy of filing an appeal before the Divisional Commissioner, Magadh Division,

Patna High Court CWJC No.10542 of 2015(2) dt.18-08-2023 2/2 Gaya, hence, he may avail the aforesaid remedy. 3.

Accordingly, I deem it fit and proper to dispose off the present writ petition with liberty to the petitioner to avail the remedy of appeal.
