2. The petitioners seeks bail in connection with S.T. 31 of 2023, Banka P.S. Case No. 540 of 2021 dated 07.07.2021 registered for the offence punishable under Sections 341, 323, 504, 506, 34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code has been added on 13.08.2021.

3. The prosecution case, in short, is that when the informant was going in the morning for natural call and he reached at the house of Anandi Mandal then one Kishor Mandal came and pointed out pistol at his temporal and threatened to kill him and all the accused persons started to assault the informant and the informant fell unconscious.

4. Learned Counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this

It is further stated that co-accused Kishor Mandal has been granted bail vide Criminal Miscellaneous No. 12770 of 2022 dated 05.07.2022, Jitendra Mandal and Sunil Mandal have been granted bail vide Criminal Miscellaneous No. 26964 of 2022 dated 12.09.2022 and Manish Mandal has been granted bail vide Criminal Miscellaneous No.17555 of 2022 dated 13.07.2022 by a Co-ordinate Bench of this Court. The petitioners are in custody since 04.11.2022, having no criminal antecedent and charge-sheet has been submitted in the case.

5. Learned A.P.P for the State opposes the prayer for bail of the petitioners.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Banka in connection with Banka P.S. Case No. 540 of 2021.
