Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner is in custody since 09.09.2019 and seeks bail in connection with Rajgir P. S. Case No.331 of 2019 registered for the offences punishable under Sections 394 of the I.P.C.
Petitioner is not named in the first information report and it is said that some cash and mobile set were recovered from the house of the petitioner.
Learned counsel for the petitioner submits that the seized mobile set as well as cash belonged to petitioner and
Patna High Court CR. MISC. No.20799 of 2020(2) dt.09-09-2020 2/2 except one criminal antecedent, there is no other criminal antecedent of the petitioner. It is also pointed out that some coaccused, having more or less similar allegation, have already been granted privilege of bail.
Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Rajgir P. S. Case No.331 of 2019.
