JUSTICE ARUN KUMAR ORAL ORDER 10-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Araria PS Case No. 492 of 2017 registered under Sections 379/34 of the IPC. The allegation in brief is that the accused persons committed theft of Thirty-seven thousand rupees from the cash box of the shop of the informant.

Learned Counsel for the petitioner submits that he is resident of far away place, he was traveling and when went to purchase some eatable items protested against the expiry products being given, so falsely implicated in this case with allegation of committing theft. The petitioner has no criminal antecedent and is in custody since 17.7.2017. Charge-sheet too has been submitted in this case. Having considered the said facts and circumstances, the petitioner, namely, Md. Shabbir is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Araria in connection with Araria PS Case No. 492 of 2017.
