JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2018 Heard learned counsel appearing on behalf the petitioner and counsel appearing on behalf of the State. The petitioner is in custody since 31.03.2018 in connection with Manjhaulia P.S. Case No. 67 of 2018 for the offence under Section 399, 402 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 31.03.2018. He further submits that in the instant case only mobile was alleged to have been recovered from the possession of the petitioner. He submits that neither country made pistol nor any cartridge was recovered from the possession of this petitioner. He submits that coaccused Md. Sabir and Rahul & others have already been granted bail by Co-ordinate Bench of this Court vide order dated 25.6.2018 and 29.6.2018 respectively in Crl. Misc. No. 33959 of

Patna High Court Cr.Misc. No.54924 of 2018(2) dt.28-09-2018 2/2 2018 and 36385 of 2018 respectively.

Considering the aforesaid, let the petitioner named above, to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Manjahulia P.S. Case No. 67 of 2018.
