The petitioner is in custody in connection with Ara Town P.S.Case No.366 of 2017 registered for an offence under Sections 302/120(B)/34 of the IPC and Section 27 of the Arms Act.

It has been submitted that the petitioner is neither named in the FIR nor there is specific allegation against him. The name of this petitioner appeared in the confessional statement of co-accused Raja and Nurain Alam. The other co-accused Indra Bhan Singh and Md. Shahid Ali @ Shahid Ali who are named in the FIR have been allowed bail by this Court in Cr.Misc.No.45527 of 2017 and 44504 of 2017. The petitioner is in custody since 07.07.2017 having clean antecedent.

Patna High Court Cr.Misc. No.62880 of 2017 (2) dt.10-01-2018 2/2 Learned APP opposed the submissions.

In the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Bhojpur at Ara in connection with Ara Town P.S.Case No.366 of 2017.
