JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 24.12.2021, is a person with clean antecedent and prosecution report has been submitted in the case.
Allegation is of recovery of 107.700 litres of liquor from a gunny bag kept on a motorcycle being driven by the petitioner.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.19566 of 2022(2) dt.22-04-2022 2/2 petitioner has been falsely implicated in the present case, he had parked his bike and thus was not aware who had kept the gunny bag on his bike and came to be arrested when the search was made.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 24.12.2021, is a person with clean antecedent and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Excise Case No. 240 of 2022 corresponding to P.R. Case No. 59 of 2021/22 (Satyavrat Verma, J) Rishi/- U T
