JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-12-2018 The learned counsel for the respondents submits that as stated in the counter-affidavit, the outstanding dues has already been sanctioned to the tune of Rs. 9, 18, 491/-, however, on account of paucity of fund it will take some time to pay the same.
The learned Senior counsel appearing for the petitioner submits that since now the authorities have found that outstanding amount is due for payment, some interest should be awarded.
Having considered the rival submission of the learned
Patna High Court CWJC No.15073 of 2016(2) dt.17-12-2018 2/2 counsel for the parties, this Court is of the opinion that the respondents are entitled to pay the aforesaid amount of Rs. 9,18, 492/- to the petitioner within a period of four weeks from today. In case the said amount is not paid within the said period of four weeks, the same shall carry interest @ 6% per annum from the date the said amount became due for payment upto the date of payment.
