JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2019 This application, for grant of anticipatory bail, arises out of Misc. Excise Case No. 670/2018, disclosing offences under Sections 30(a)/37(B) of the Bihar Prohibition of Excise Act, 2016.
Allegation is of recovery of 1500 bottles of nepali liquor each containing 300 M.L. from Tata Safari vehilce and petitioner is named in the F.I.R. Apart from that he is accused in two more cases of similar nature.
Submission of learned counsel for the petitioner is that he has falsely been made accused in this case and has nothing has been recovered from his instance and the vehicle in question does not belong to him.
Heard learned A.P.P. also.

No.21490 of 2019(2) dt.10-05-2019 2/2 Having heard both sides, considering the facts and circumstances as well as the fact that petitioner is an accused in two more case of similar nature, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case.
