The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 406, 467, 468, 471, 120B and 34 of the Indian Penal Code. As per the prosecution case, it is stated by the informant that on secret information having been received that a cyber crime was being committed through mobile phones, a raid was conducted and from the house of Sumant Kumar @ Golu, one accused namely, Mantu Kumar was arrested and various incriminating articles, details of which has been given in the F.I.R., were recovered.

It is submitted by learned counsel for the petitioner that from F.I.R., it would be evident that the arrested accused

Patna High Court CR. MISC. No.19416 of 2022(5) dt.17-01-2023 2/2 took the name of the petitioner. Except this, no other material has transpired even in course of investigation to connect the petitioner with the alleged crime. The petitioner has been falsely implicated in the case only because of his antecedent. He is in custody since 14.2.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation, the submissions made on behalf of the petitioner, the petitioner being in custody for 1 year 11 months since 14.2.2021 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Sheikhopur Sarai P.S. Case no.63 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura.
