Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 406, 504,506/34 of the Indian Penal Code.

The prosecution case is that the petitioner who was tenant of the informant with whom the informant made negotiation with regard to her marriage, took Rs. 2 lacs and some gold ornaments from the informant and after that he shifted to some other house on rent.

It is submitted by the learned counsel for the petitioner that there had been no negotation of marriage and there is no proof that informant gave any money or jewellery to the petitioner. The petitioner was working in a jewellery shop when the father of the informant took Rs. 50,000/- loan after mortgaging ornaments but when the petitioner demanded money, the informant and her family members threatened him as a result

Patna High Court Cr.Misc. No.32432 of 2015 (2) dt.10-08-2015 2/2 he lodged informatory petition no. 2778 of 2014 dated 04.09.2014. Considering the aforementioned facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for six months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Digha P.S. Case No. 224 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
