The petitioner seeks bail in Ramgarhawa P.S. Case No. 79 of 2016 registered under Section 394 and 411 of the Indian Penal Code.
As per the prosecution case, four unknown miscreants are said to have looted the motorcycle, mobile phone, golden chain and cash of Rs.6000/- of the informant. It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. Nothing incriminating article has been recovered from his conscious physical possession rather the looted motorcycle is said to have been recovered from the possession of Arvind Kumar alias Chhotu on the basis of confessional statement
Patna High Court Cr.Misc. No.54277 of 2017 (02) dt.13-12-2017 - 2 - of the petitioner recorded by the police in Adapur P.S. Case No.181 of 2016 preceding to filing of the case under hand. The petitioner happens to be a simple mechanic and runs a garage. The petitioner has been languishing in custody since 22.06.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in connection with Ramgarhwa P.S. Case No.79 of 2016.
