====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-04-2025 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 223, 109 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.

3. As per the prosecution case, all the FIR named accused persons including this petitioner was involved in the firing between two groups at the time of idol immersion.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Allegation of firing is general and omnibus against this petitioner and no specific overt act has been alleged against him. Nobody sustained fire arms injury.

Patna High Court CR. MISC. No.18058 of 2025(2) dt.10-04-2025 2/2 Co-accused, with similar allegation, has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No. 14361/2025.

5. Learned counsel for the State opposes the prayer submitting that the petitioner is named in the FIR. He has five criminal antecedents of which some are of serious nature.

6. Considering the criminal antecedent of the petitioner, his prayer for bail is refused.
