2. The petitioner seeks regular bail in connection with Govindganj P.S. Case No. 300 of 2025 registered for the offence under Section(s) 76 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 8 of the POCSO Act.

3. As per the prosecution case, the petitioner is alleged to have sexually assaulted the victim.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. It is further submitted that both parties have amicably settled their disputes.

5. Learned counsel appearing for O.P. No. 2 submits that O.P. No. 2 has no objection to the prayer made on behalf of the petitioner.

6. Having regard to the submissions advanced on behalf of the parties, the present application is disposed of with liberty to the petitioner to approach the Court below by filing a compromise petition if the same has not already been filed.

7. If any such application is filed, the Court below shall examine the genuineness of the compromise. If the Court below is satisfied that the compromise is genuine and is duly supported by O.P. No. 2/the victim, the petitioner shall be released on regular bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court.

8. In the event the Court below finds that the compromise is not genuine or is not supported by O.P. No. 2/the victim, an appropriate order shall be passed by the Court below in accordance with law.
