The petitioners are accused in Bousi Police Station Case No 43 of 2017 registered for the offences punishable under Sections 413, 414 of Indian Penal Code.

The stolen motorcycles are said to have been recovered. The petitioners have been arrested in connection with the said recovery and upon their arrest, they have been implicated in two other cases. Counsel for the petitioners submits that merely on the basis of suspicion, they have been arrested as the first information report discloses that the police party had proceeded only upon information that the stolen motorcycles were lying

Patna High Court Cr.Misc. No.55772 of 2017 (2) dt.15-12-2017 2/2 abandoned near the Kumhar Canal. The petitioners dispute the seizure that upon their arrest, their signatures were obtained on blank papers and the same are not in accordance with law. They are in custody in connection with this case since 04.05.2017. Having regard to the submissions made on behalf of the petitioners, prayer for bail is allowed. Let the petitioners above named be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Araria in Bousi Police Station Case No 43 of 2017 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.

(2) That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
