The petitioner seeks regular bail in connection with Kalyanpur P.S. Case No. 203 of 2018, registered for the offence punishable under Sections 376 and 511 of the Indian Penal Code.

The allegation is regarding the petitioner having harassed the victim girl and tried to rape her, however, he was caught by the villagers and thrashed.

The learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case, however, he undertakes to keep good

Patna High Court CR. MISC. No.17139 of 2019(2) dt.01-04-2019 2/2 behaviour in future. It is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 28.11.2018.

The learned counsel for the informant has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case No. 203 of 2018.

It is further directed that the petitioner shall keep good behaviour and shall not harass the victim girl and in case of any such complaint being made before this Court by the informant, this Court would consider cancelling the privilege of bail being granted by this Court.
