Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code. Petitioner and six others are named in the first information report and it is specific case of the informant that co- accused- Mahesh hurled dagger blow causing injury on his left chest. Subsequently, it is stated that petitioner also gave dagger blow to the informant but it is not clear from written report of the informant that assault of the petitioner hits which part of the informant.
Moreover, injury report of the informant reveals that he sustained only two injuries but both aforesaid injuries were found
Patna High Court Cr.Misc. No.25290 of 2016 (3) dt.20-06-2016 simple in nature and moreover, only one injury said to be caused by sharp cutting weapon was found on the person of the informant. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Magistrate, Jamui in Jhajha P.S. Case no. 49/2016.
