KUMAR ORAL ORDER 02-02-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Aalamganj (Patna) P. S. Case no. 154 of 2017 registered for the offences punishable under Sections 467, 468 and 120B of the Indian Penal Code and Section 36 of the Drugs and Cosmetics (Amendment) Act, 2008 and rule 7(i) (ii) of the Drug Price Control Order, 2013 and Section 26 of the essential Commodities Act, 1955.
Allegation is that a raid was conducted at the dispensary and drug manufacturing locations of the accused persons and different types of spurious medicines and labels were recovered from there.
It is submitted on behalf of the petitioner that he is not
Patna High Court Cr.Misc. No.1228 of 2018(4) dt.02-02-2018 2/2 named in the FIR and his name has transpired in the confessional statement of co-accused. Witnesses examined during investigation do not support the prosecution case. There is general and omnibus allegation against petitioner. He has got no criminal antecedent and is in custody since 05.07. 2017. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Alamganj (Patna) P.S. Case no. 154 of 2017.
