JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 and 34 of the Indian Penal Code read with Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 02.01.2022, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 1120.500 litres of liquor from an ambulance.
Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name was disclosed by the villagers with whom he was on an inimical

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 02.01.2022, is a person with clean antecedent, chargesheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Karja P.S. Case No. 259 of 2021. (Satyavrat Verma, J) Rishi/- U T
