The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 324, 325, 307, 379, 504 and 506/34 of the Indian Penal Code, registered in connection with Palasi P.S.Case No.162 of 2017.

As per the allegation, the accused persons badly assaulted the family members of the informant Md. Shakir. The allegation against the present petitioner is that he inflicted iron rod on the head of Md. Tarik.

Learned counsel for the petitioner has submitted that this case is a counterblast to Palasi P.S.Case No. 161 of 2017 wherein Raifun Nisha has levelled allegation of similar nature

Patna High Court CR. MISC. No.16443 of 2020(2) dt.07-12-2021 2/2 against the petitioner and his family members. He has also submitted that the injury report of Md. Tarik has been annexed as Annexure-3 and the injury has been caused by hard and blunt substance, which is simple in nature.

On the other hand, learned APP has opposed the prayer for anticipatory bail.

Considering the fact that the nature of injury is simple, caused by hard and blunt substance, let the petitioner abovenamed, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Araria, in connection with Palasi P.S.Case No.162 of 2017, subject to the conditions as laid down under Section 438(2) Cr. P.C.
