JUSTICE SATYAVRAT VERMA ORAL ORDER 30-09-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual Court proceedings. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 337, 338, 353, 333, 334, 307, 304, 504 and 427 of the Indian Penal Code, Section 27 of the Arms Act and Section 3 of the Damage to Public Property Act. The informant alleges that on account of death of an undertrial prisoner, the accused persons were protesting and had blocked NH-10 and when informant with police force reached the place of occurrence, the mob become aggressive and started pelting stones, further one constable Kanti Devi

Patna High Court CR. MISC. No.20056 of 2022(2) dt.30-09-2022 2/3 was crushed to death by a vehicle and the mob fired also and tried to snatch arms from the police, thus the police had to resort to eight rounds of fire.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and are women, it is next submitted that petitioners have been falsely implicated in the present case. Learned counsel next submits that petitioners being villagers had gone to the place of occurrence to see why the protest was going on, it is also submitted that the allegations against them are not specific rather the allegations are general and omnibus in nature. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Parasbigha P.S. Case No. 125 of 2021 subject to the
