2. Learned counsel for the petitioners submits that petitioner no. 1, namely, Satyendra Kumar @ Luv Kumar has been arrested in this case. In that circumstance, learned counsel for the petitioners seeks permission to withdraw this bail application in respect of petitioner no. 1, namely, Satyendra Kumar @ Luv Kumar.

3. Permission is accorded.

4. This application is dismissed as withdrawn in respect of petitioner no. 1.

5. The instant application for anticipatory bail has been filed by the petitioner no. 2 apprehending his arrest in

Patna High Court CR. MISC. No.18676 of 2025(2) dt.18-04-2025 2/3 connection with Naubatpur P.S. Case No. 822 of 2024 instituted for the offence under Sections 126(2), 115(2), 109, 329(4), 352 and 3(5) of B.N.S., 2023 and Sections 25(1-B)(a), 26, 35 and 27 of the Arms Act.

6. The case of the prosecution is that the petitioner along with others opened fire upon the informant and others.

7. Learned counsel appearing on behalf of the petitioner no. 2 has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The nature of allegation is general and omnibus. There is no specific allegation against the petitioner. It has further been submitted that in this occurrence, nobody has received any injury. It has also been submitted that similarly situated coaccused persons have already been granted anticipatory bail by learned Co-ordinate Bench of this Court vide order dated 16.04.2025 in Cr. Misc. No. 18383 of 2025. The case of this petitioner stands on similar footing.

8. Learned APP appearing for the State has opposed the prayer of bail of the petitioner no.2.

9. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner no. 2, namely, Harsh

Patna High Court CR. MISC. No.18676 of 2025(2) dt.18-04-2025 3/3 Kumar on bail. The petitioner no. 2 is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Naubatpur P.S. Case No. 822 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Danapur, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
