2. The petitioner seeks bail in connection with Sasaram Town P.S. Case No. 1035 of 2024 dated 26.12.2024 registered for the offence punishable under Sections 109, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. The prosecution case, in short, is that on the date of occurrence the informant received a call from Riaz Khan on his mobile who said that Bablu Idrishi (petitioner), Pintu Idrishi, Mohd. Aamir Idrishi want to meet you. When the informant came to meet, Bablu Idrishi said that why don't you settle Sasaram Nagar Police Station Case No.

Patna High Court CR. MISC. No.23704 of 2025(2) dt.01-05-2025 2/3 707/2023. Upon refusal, Bablu Idrishi and Pintu Idrishi took a pistol and said that if you do not settle the case, we will kill you and Bablu Idrishi opened fire at the informant.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that the allegation against the petitioner and another co-accused is that they opened fire upon the informant with their pistols. It is submitted that no incriminating articles have been recovered from the possession of the petitioner and no empty cartridge was found at the place of occurrence. It is further submitted that the allegation against the petitioner is totally false and concocted. Lastly, it has been submitted that the petitioner is in custody since 27.12.2024, having no criminal antecedent and charge-sheet has been submitted in the case.

5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties
