The petitioner seeks bail in connection with Sitamarhi P.S. Case No. 549 of 2017 dated 17.07.2017 instituted for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016. Around twenty four litres of Nepali liquor is said to have been recovered from the possession of the petitioner. The petitioner is in custody since 13.10.2017 and does not bear criminal antecedent.

Regard being had to the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten

Patna High Court Cr.Misc. No.56313 of 2017 (2) dt.05-12-2017 2/2 thousand) with sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Sitamarhi P.S. Case No. 549 of 2017.
