In the said circumstances, the order dated 12.9.2018 reads as follows :

Heard the parties.

Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 12.1.2018 passed in Cr.Misc.No. 62677 of 2017 and there is allegation against the petitioner of assault by Tangi, due to which he died.

Submission of the learned cou9nsel for the petitioner is that he is in custody for more than one year and up-till-now only one witness has been examined.

Patna High Court Cr.Misc. No.51559 of 2018 (4) dt.26-09-2018 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, since the petitioner is in custody for one year, the learned trial court is directed to expedite the trial and try to conclude it on regular basis so that it may be concluded as soon as possible. At the same time, the S.P., Gopalganj is directed to ensure presence of the witnesses in the trial court on date fixed. With the aforesaid observation, this application is dismissed.

Let this order be communicated to the court concerned forthwith.
