JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 Petitioner seeks regular bail in connection with Phulwariya P.S. Case No.257 of 2018 registered for the offences punishable under Sections 302, 201, 120(B), 379 and 34 of the Indian Penal Code.

Allegation as per written report is that the brother-inlaw (Bahnoi) of the informant was residing in foreign country and Dewar of the sister of informant, namely, Mobin Alam committed theft of mobile of his sister on 07.11.2018 and he has given threatening. On 08.11.2018 he received an information that his sister has been locked from the inside and villagers were trying to open the lock and after breaking the lock, he found that his sister was died in the latrine, her legs and mouth were tied. Submission of the learned counsel for the petitioner is that though the petitioner is not residing in the same house but

No.17944 of 2019(2) dt.20-05-2019 2/2 residing in some other village and no specific allegation has been attributed against him and other co-accused Kalim Mian has been granted privilege of bail by a Co-ordinate Bench of this Court vide order dated 11.04.2019 in Criminal Misc. No.22782 of 2019. Further submission is that petitioner is in custody since 17.11.2018.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-XIII, Gopalganj, in connection with Phulwariya P.S. Case No.257 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
