Petitioner seeks bail in a case registered under Section 461, 379 of Indian Penal Code.

The allegation in the first information report is regarding theft of cell phone and cash from the shop of the informant which has been recorded in the CCTV. First information report is against unknown persons. Counsel for the petitioner submits that he is a bona fide purchaser of the cell phone which is said to be one of the stolen articles from the shop of the informant. He submits that he has been implicated in this case merely on suspicion and that he has no criminal antecedent prior to the instant case. He is in custody in connection with this case since 03.11.2017.

Patna High Court Cr.Misc. No.575 of 2018 (2) dt.11-01-2018 2/2 Considering the aforesaid submissions, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in Routa Police Station Case No 115 of 2017 subject to the following conditions: (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
