JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code. Petitioner is not named in the First Information Report, but, in course of investigation, the statement of one witness, namely, Rita Devi was recorded when the said witness disclosed the name of co-accused Dinesh Chaudhary, who was subsequently, arrested and made his confessional statement disclosing the name of petitioner. The statements of two other witnesses were also recorded vide para 64 and 65 of the case diary, but the said statement was recorded near about after two years of the alleged occurrence.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.27403 of 2016 (3) dt.06-09-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Deo P.S.
