JUSTICE SUDHIR SINGH ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 30.11.2015 in connection with Jokihat P.S. Case No. 320 of 2015 for the offences instituted under Sections 467, 468, 471, 420 and 414 of the IPC.

It is alleged that on search made by the police, one country made loaded pistol alongwith mobile phone was recovered from conscious possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.11.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. For the

Patna High Court Cr.Misc. No.25622 of 2016 (3) dt.11-08-2016 2/2 same offence, three cases were instituted. In two cases, the petitioner has already been granted bail. The other co-accused has been granted bail in the present case vide Cr. Misc. No. 7932/2016 by another co-ordinate Bench of this Court.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria, in connection with Jokihat P.S.
