The petitioner seeks regular bail in connection with Gaya Mufassil P.S. Case No. 368 of 2017 for the offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 42 liters of foreign liquor from a Bolero vehicle which is said to have been driven by the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, the petitioner is not the owner of the vehicle, he has a clean antecedent and he is in custody since 30.11.2017.

Patna High Court Cr.Misc. No.853 of 2018 (2) dt.18-01-2018 2/2 Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Gaya in connection with Gaya Muffasil P.S. Case No. 368 of 2017.
