Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 341, 387, 324, 307 and 379/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per allegation, the petitioner called the informant on phone and when he came the petitioner demanded Rs. 50,000/- as Rangdari and on protest co-accused Dablu Kumar fired shot but the informant was saved. Co-accused Dhiraj Kumar also attempted to stab at the stomach of the informant but he held the knife on his left hand.

Patna High Court CR. MISC. No.28935 of 2021(5) dt.23-03-2022 2/2 Learned counsel for the petitioner has submitted that the real fact is that the accused persons and the informant were friends. Some dispute arose between co-accused Pintu and the informant Rahul Kumar. The informant was expecting the petitioner to be an eye witness of the case and on refusal of the present petitioner to be an eye witness, the informant has falsely implicated the petitioner. Learned APP for the State has submitted that the investigation is going on.

Considering the above facts and circumstances and that the petitioner has clean antecedent, let the petitioner, above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Danapur, Patna in connection with Maner P.S. Case No. 568 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing with the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) Jagdish/- U T
