JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 11-02-2015 Through the present application the petitioner has renewed his prayer for anticipatory bail in connection with Complaint Case No. 2230 of 2011 wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 323 of the Indian Penal Code and 3/4 of Dowry Prohibition Act pending in the court of learned Sub-divisional Judicial Magistrate, Gopalganj. The petitioner was granted provisional anticipatory bail vide order dated 21.02.2013 passed in Cr. Misc. No. 3078 of 2013. The same was to be confirmed by the learned court below on substantial restoration of matrimonial harmony or

Patna High Court Cr.Misc. No.22147 of 2014 (02) dt.11-02-2015 2/2 the complainant deliberately refuses to reside with the petitioner or the complainant fails to appear before the learned court below. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application to file appropriate modification application.
