JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 47, 53(B) of Bihar Excise (Amendment) Act, 2016.

Petitioner is in jail custody since 30.04.2016 on the accusation that 30 pieces of 300 ml each liquor of Nepali origin were recovered while petitioner and one co-accused were caught by the police officials.

Submission on behalf of the petitioner is that nothing has been recovered from conscious possession of the petitioner and moreover, petitioner does not have any criminal antecedent.

No.26283 of 2016 (2) dt.11-07-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Sursand P.S. Case No. 68 of 2016.
