20-09-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
Petitioners, in the present case, are seeking regular bail in connection with Lakhisarai P.S. Case No. 218 of 2018 registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that petitioner no. 1 is elder brother-in-law whereas petitioner no. 2 is younger brother-in-law of the deceased. It is submitted that they have been made accused in the present case only because they happened to be the brothers of the husband of the deceased. It is submitted that there is no eye witness of the alleged occurrence and the allegations are general and omnibus. It is submitted that the mother-in-law and father-in-
Patna High Court Cr.Misc. No.51979 of 2018 (2) dt.20-09-2018 law have been granted regular bail by the learned co-ordinate Bench of this court in Cr. Misc. No. 43363/2018 (Annexure2). Learned Additional Public Prosecutor for the State opposes the prayer for regular bail of the petitioners. Considering the facts and circumstances wherein the father-in-law and mother-in-law have already been granted regular bail and these two petitioners are the brother-in-laws of the deceased, let the above named petitioners be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai P.S. Case No. 218 of 2018, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
