KUMAR ORAL ORDER 04-10-2018 Heard learned counsel for petitioner, learned counsel for the informant as well as learned counsel for the State. Petitioner, who is in custody, seeks bail in connection with K. Hat (Maranga) P.S. Case No. 33 of 2018 registered for the offences punishable under Sections 363, 370, 302, 201 and 120B of the Indian Penal Code.

Allegation against petitioner and other co-accused persons is kidnapping and killing of the brother of the informant.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. He is not named in FIR. Nothing has been recovered from his possession. Name of the

No.51940 of 2018(2) dt.04-10-2018 2/2 petitioner has surfaced in this case on the basis of confessional statement of one Pani Mandal and except this confession there is no incriminating material against the petitioner. He is in custody since 19.04.2018. It has been further submitted that similarly placed co-accused, namely Pani Mandal and Indrajeet Kumar have been granted bail by other co-ordinate Bench of this Court as well as this Court in Cr. Misc. No. 40398 of 2018 and 15196 of 2018 vide order dated 11.07.2018 and 06.04.2018 respectively.

Learned counsel for the informant has vehemently opposes prayer of bail.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia in connection with K. Hat (Maranga) P.S. Case No. 33 of 2018.
