JUSTICE RAKESH KUMAR ORAL ORDER 04-12-2017 Heard Sri Birendra Kumar Singh, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, who is in custody since 1.10.2017 in Amba P.S. Case No. 126 of 2017, registered for the offence under Section 30(a) & 38 of the Bihar Prohibition And Excise Act , 2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated in the present case. He submits that though recovery of 86 liters of country made liquor was shown from a motorcycle , the petitioner was having no connection with the said motorcycle. The petitioner had gone to attend natural call, but falsely apprehended and he is in custody. Learned counsel for the petitioner has also drawn my attention to the statement made in paragraph no. 3 of the
Patna High Court Cr.Misc. No.55614 of 2017(2) dt.04-12-2017 2/2 petition to show that petitioner is having clean antecedent. Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner Binod Ram @ Binod Paswan be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned ADJ VII - cumSpecial Judge ( Excise) Aurangabad / concerned court in connection with Amba P.S.
