2. Earlier petitioner had been granted anticipatory bail in this case vide order dated 3.4.2023, passed in Cr.Mis.No. 22284 of 2022 but the petitioner could not surrender and furnish bail bonds within the stipulated time on the ground of illness. Petitioner is in custody since 18.12.2024. Charge sheet has already been filed.
3. Learned counsel for the CBI opposes the prayer for bail.
4. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of
Patna High Court CR. MISC. No.21314 of 2025(5) dt.22-08-2025 2/2 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, CBI II, Patna in Special Case No. 02/2019 on the following conditions:- (i) Petitioner shall co-operate with trial and shall be properly represented on each and every date fixed by the trial court and shall remain physically present as directed by the trial court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the trial court.
(ii) If the petitioner is found tampering with the evidence or the witnesses in this case, the prosecution will be at liberty to move for cancellation of bail.
