17-11-2017 Heard Sri Manoj Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 26-08-2017 in Madhepura P.S. Case No. 595 of 2017 registered for offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. He further submits that on false accusation of recovery of about 23 liter of Indian make foreign liquor from so called hut type hotel of the petitioner, the petitioner has been made accused and he is languishing in jail since his arrest.

Considering the nature of accusation, clean antecedent as
