JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302/34 of the Indian Penal Code.

Petitioner happens to be own Sarhu of deceased who was working as driver with the petitioner. The informant claims that on the alleged date of occurrence, the deceased left his home in the company of the petitioner but subsequently, the dead body of the deceased was recovered from a field near Karamhari village. The informant expressed his suspicion against the petitioner and others on the ground that 10 days prior to the alleged occurrence, an altercation had taken place between the deceased and the petitioner as well as some others.

No.25408 of 2016 (3) dt.20-06-2016 2/2 Admittedly, none has seen actual killing of the deceased and except suspicion, there appears to be nothing against the petitioner who is languishing in jail custody since 27-03-2016. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mohania P.S. Case No. 154 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua.
