2. The petitioner apprehends his arrest for the offences alleged under Section 135 of the Electricity Act registered in connection with Muffasil P.S. Case No. 387 of 2013.
3. It is submitted that the petitioner has been falsely implicated and he is in no way connected with the offence of theft of electricity. The flour mill in question is run by the petitioner by Diesel Engine and not by electricity. In any event the petitioner expresses that he is ready to deposit the amount of loss said to have been caused to the respondent Board by reason of such theft.
4. Having regard to the entirety of the facts and circumstances, in the event of the petitioner's arrest or
Patna High Court Cr.Misc. No.37161 of 2014 (2) dt.11-02-2015 surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge (Electricity), Magadh Area, Gaya in connection with Muffasil P.S. Case No. 387 of 2013, subject to the conditions as laid down under Section 438 (2) Cr.P.C., with the additional condition that the petitioner shall deposit the amount of Rs. 1,98,480/-in four equal monthly instalments which shall be subject to the final result of the trial. Failure to make deposit of even a single instalment within time, his bail bond will be liable to be cancelled by the Court concerned.
