The petitioner seeks bail in connection with Routa P.S. Case No. 91 of 2017 dated 10.09.2017 instituted for the offences under Sections 363, 366A/34 of the Indian Penal Code. The daughter of the informant who is said to be of 16 years of age, went missing. The informant initially raised suspicion against one Md. Rahbar, his tenant, who is alleged to have eloped with his daughter. In the F.I.R, it has been alleged that the petitioner, who is brother of Md. Rahbar, had assisted in taking away the daughter of the informant.

The daughter of the informant, on the other hand, in her 164 statement, has clearly stated that she was in love with Md. Rahbar and was also pregnant. This fact was not known

Patna High Court Cr.Misc. No.56176 of 2017 (2) dt.29-11-2017 2/2 to her parents and therefore she had stealthily come out of her house on 09.09.2017 and had gone to Purnea. In her 164 statement, the victim has not stated anything about the petitioner and has stated her age to be 18 years.

The petitioner is in custody since 14.09.2017. Regard being had to the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Purnea in connection with Routa P.S.
