JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379 and 461 of the Indian Penal Code.

Petitioner is not named in the First Information Report and during course of investigation, one Md. Rashid @ Pappu was arrested and stolen firearms were recovered from his house. The aforesaid co-accused confessed his guilt disclosing the name of the petitioner and two others.

Learned counsel for the petitioner submits that having more or less similar allegation, co-accused Md. Sarik has already been granted privilege of bail by a co-ordinate Bench of

Patna High Court Cr.Misc. No.25621 of 2016 (2) dt.21-06-2016 this Court.

Taking note of the above submissions and this aspect of the matter that except confessional statement of co-accused as well as some criminal antecedents, there is nothing against the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Civil Line P.S.
