The petitioner seeks regular bail in connection with Bettiah Town (Kalibagh O.P.) P.S. Case No. 540 of 2018 for the offences punishable under Sections 341, 323, 324, 307, 34, 379 of the Indian Penal Code.

The allegation is regarding unknown miscreants having assaulted the informant and having taken away the motorcycle of the informant.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that neither any recovery has been made from possession of the petitioner nor any T.I. Parade has been held to

It is further submitted that the name of the petitioner has transpired from the confessional statement made by the co-accused person, namely Shivam Kumar Mishra and apart from that, there is no material to connect the petitioner with the alleged crime. The petitioner is stated to be languishing in custody since 20.11.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town (Kalibagh O.P.) P.S. Case No. 540 of 2018.
