JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner, the learned APP for the State and learned counsel for the informant. The petitioner seeks bail in Sursand P. S. Case No. 137 of 2016 instituted for the offence under Section(s) 341, 323, 365, 366 and 376 of the IPC.

It is alleged against this petitioner that he took the informant with him on 22.6.2016 to Surat on the pretext to perform marriage with her and also established physical relationship with her several times. Finally, he brought her to his home village Kamaldah and did not agree to perform marriage.

Learned counsel for the petitioner has submitted that victim is the major girl. She has voluntarily gone with the

Petitioner is in custody since 3.11.2017 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Sitamarhi, in connection with Sursand P.S. case no. 137 of 2016, subject to the condition that both the bailors shall be the close relative of the petitioner.
