The petitioner is apprehending arrest in a case registered for the offences punishable under section 395 of the Indian Penal Code.

The accusation is of robbing the pick-up van of the informant by miscreants leading to registration of FIR against co accused Akhilesh Bhai and four others. The name of the petitioner sprang up on confession of co accused Binod Chaudhary. It is submitted by the learned counsel for the petitioner that neither there is recovery from the petitioner nor there is any material against the petitioner and co accused Binod Chaudhary, who named the petitioner and other similarly situated

Patna High Court Cr.Misc. No.37082 of 2015 (2) dt.14-09-2015 2/2 co accused have been granted regular bail vide Cr. Misc. Nos. 10518 and 12138 of 2015. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Jandaha P.S. Case No. 205 of 2014 pending in the court of learned JM Ist Class, Vaishali at Hajipur.

This application is disposed of with the aforesaid observation/direction.
